Terms of sale
These terms apply to all sales by Crofil 3D d.o.o., Matije Gupca 6, 32253 Komletinci, Croatia, VAT ID HR98738901121 (“we”) through filamenti.eu. Filamenti.eu sells to businesses (B2B). By ordering, the customer confirms that it is acting in the course of its business.
1. Offers and contract
Information on the website is not a binding offer. The customer sends a quote request; we send a written quote (price, quantity, production slot, delivery terms, validity). The contract is concluded when the customer accepts the quote in writing (e-mail is sufficient) or pays the pro-forma invoice.
2. Prices
Prices are net prices in EUR excluding VAT, unless stated otherwise. Shipping costs are stated separately in the quote. For customers in another EU member state with a VAT ID valid in VIES, the supply is VAT-exempt as an intra-Community supply (reverse charge, Art. 196 of Directive 2006/112/EC); the customer is responsible for accounting for VAT in its country. Croatian customers are charged Croatian VAT.
3. Payment
Unless agreed otherwise, payment is made in advance by bank transfer against our pro-forma invoice. Production starts after payment is received. Payment terms for regular customers may be agreed individually.
4. Production and delivery
Goods are produced to order. Delivery dates are estimates unless expressly confirmed as fixed. Risk passes to the customer when the goods are handed to the carrier (FCA Komletinci, Incoterms 2020) unless the quote states otherwise.
5. Inspection and complaints
The customer must inspect goods on receipt. Visible defects and transport damage must be reported within 3 working days, hidden defects within 8 days of discovery and no later than 6 months after delivery, with photos and the batch number from the spool label. For justified complaints we replace the goods or refund the price, at our choice.
6. Liability
Our liability is limited to the value of the delivered goods, except in cases of intent or gross negligence. We are not liable for indirect damage, lost profit, or failed prints caused by printer settings, storage conditions or unsuitable use. Filament should be stored dry; moisture-related print problems are not a defect.
7. Retention of title
Goods remain our property until paid in full.
8. Applicable law
Croatian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The court with jurisdiction at our registered office has jurisdiction.
